A resident living opposite Ramon Aramon i Serra park in Barcelona’s Sants-Montjuïc district filed a formal complaint with the Barcelona Ombudsman’s Office in June 2026, alleging persistent noise disturbances caused by a group of children and young people aged 12 to 18 playing ball daily against the facade of her building on Carrer de Leiva.

The complainant stated that the impacts and constant noise force neighbours to keep windows shut and some to use earplugs. She added that when confronted, some of the teenagers respond with threatening behaviour and mockery, and that the Sants-Montjuïc District had taken no effective action despite repeated complaints.

## Ombudsman Finds Rights in Tension

The Sindicatura de Greuges (Ombudsman’s Office) acknowledged the conflict between two protected rights: the right of minors to play in public spaces and the right of residents to peaceful coexistence. In its resolution dated 3 July 2026, following inquiries with the district, it noted that municipal observations had not confirmed a recurring or habitual issue significant enough to prompt intervention.

However, the Ombudsman recognised that a group of teenagers with balls had been observed on at least one occasion, requiring officials to remind them to respect their surroundings. It concluded that while the district’s initial response was diligent, the observation period may not have been representative of the full extent of the problem.

> "The case creates tension between two legitimate rights: the right of children and adolescents to play in a public space and the right of residents to rest."

## Recommendations for Mediation

The Ombudsman recommended that the Sants-Montjuïc District deepen its investigation, directly contact the complainant and other potentially affected residents, and consider mediation and coexistence measures. These should aim to balance the right to play with the right to rest, ensuring both community needs are addressed.
