The planned eviction of two people from an occupied home in Plaça de Rubies, in Sant Cugat del Vallès's La Floresta district, was postponed on Friday 23rd October, according to reporting by Cugat Mèdia. No replacement date has been announced.

The postponement means the two occupants, who have lived at the address since August 2023, remain in the property for now. The Sant Cugat Tenants' Union supported their decision not to leave voluntarily and had called an emergency gathering outside the home.

Cugat Mèdia reported that the eviction followed criminal proceedings for alleged usurpation. In this legal context, usurpation refers to the alleged unauthorised occupation of a property without the owner's consent, rather than a dispute over a tenancy agreement.

## Dispute over notice and vulnerability claim

A friend and neighbour of the occupants told Cugat Mèdia that two officers from the Mossos d'Esquadra Community Relations Office, the regional police force's neighbourhood liaison unit, visited the property at about 12.30pm on Wednesday 21st October. The friend said they were told that the occupants would have to leave on Friday 23rd October.

The account has not been confirmed by Mossos d'Esquadra. The Ajuntament de Sant Cugat lists the local Mossos district police station at Carrer d'Alfons d'Aragó, 3, and gives [112 as the emergency contact number](https://www.santcugat.cat/directori/mossos-d-esquadra-comissaria-de-districte-sant-cugat-del-valles?ref=barna.news).

Francesc Dalmau, a member of the Sant Cugat Tenants' Union, said the reported notice period of less than 48 hours was “completely disproportionate”.

> “The owner wants it back immediately.”The property's lawyer, as quoted by Cugat Mèdia

The union said one occupant has a recognised disability assessed at 57% under Spain's disability-grading system. That assessment is above the 33% threshold at which Spanish law formally recognises a disability and can provide access to associated support and protections. Those close to the occupants said their legal defence had submitted several requests to the court to suspend the removal on grounds including that person's circumstances.

The property's lawyer told Cugat Mèdia that an initial court ruling had supported the eviction and that an appeal had also been resolved in favour of recovering the property. The lawyer said the proceedings had lasted more than three years and that further extensions of several months were not appropriate after an eviction had been judicially authorised.

## Ownership and earlier incident remain contested

The Tenants' Union and people close to the occupants said the property was sold in January 2024 to JRG GREEN 2000 SL while it was already occupied. Cugat Mèdia did not publish a property-registry document or a statement from the company confirming that account.

The property's lawyer gave a different account, saying one original heir remained connected to the ownership after agreements with the other heirs, and that changes in ownership did not remove the right to seek recovery of the home.

People close to the occupants also alleged that seven men tried to force them out in January 2024, including an alleged assault and an attempt to change the lock. They said neighbours and Mossos d'Esquadra intervened, and that the occupants later filed a complaint for alleged home invasion and assault.

Cugat Mèdia said it had not independently confirmed the alleged incident, any arrests, or an alleged link between one of the men and JRG GREEN 2000 SL. Those allegations should therefore not be treated as established facts.

## Fourth known case in recent weeks

Cugat Mèdia described the Plaça de Rubies case as the fourth eviction in Sant Cugat to become known in recent weeks that was not carried out. It said another La Floresta eviction had been deferred until 1st December, while the removal of a mother and her son from Carrer de Pau Casals had been suspended for four months.

The Ajuntament's most recent published local-security figures recorded 38 reported property occupations in Sant Cugat during 2023, down from 48 in 2022\. The Tenants' Union has said the recent cases do not necessarily indicate more evictions, but that more people are organising to oppose them.

Residents facing an immediate safety emergency should call 112\. No new date for the Plaça de Rubies eviction had been announced on Friday 23rd October.
