The decision, confirmed on Friday 23rd October 2026, follows a ruling by the Court of Justice of the European Union (CJEU) on 16th July 2026, which found that Spain's amnesty law for Catalonia does not conflict with EU law. The CJEU judgment, in Cases C-523/24 and C-666/24, addressed concerns from Spanish courts about whether the amnesty compromised the protection of victims of terrorism or EU financial interests. The Luxembourg-based court concluded that the law was compatible with European legal principles, including legal certainty and non-discrimination. --- ## Delays Followed Green Light for Amnesty Despite the CJEU's July ruling, the National Court took three additional months to implement the amnesty. The court had initially requested the European ruling as a means of delaying the process, having held back on applying the amnesty law since it came into force in 2024\. The four-page court order issued on 23rd October states: "It must be understood that the facts that are the subject of this procedure must be included" within the scope of the amnesty. The amnesty covers criminal acts connected to the Catalan independence process between 1st November 2011 and 13th November 2023\. The individuals were accused of offences including membership in a terrorist organisation, possession and manufacture of explosive substances, and attempted terrorist damage. Prosecutors had sought up to 27 years in prison for eight of the accused. > The Fiscalía de la Audiencia Nacional recommended the case be archived, confirming the acts fall within the temporal and objective scope of the amnesty law. The case was formally closed through a libre sobreseimiento, extinguishing criminal liability for Eduardo Garzón, Esther Garcia, Sonia Pascual, Queralt Casoliva, Germinal Tomàs, Alexis Codina, Jordi Ros, Rafael Joaquin Delgado, Ferran Jolis, Xavier Buigas, David Budria and Clara Borrero. ## Legal Basis and Scope of Amnesty Spain's amnesty law, adopted in 2024, was designed to normalise political and social conditions in Catalonia following the 2017 independence referendum. It applies to acts involving public funds and criminal liability tied to the referendum and broader independence movement, provided they do not involve serious intentional violations of human rights. The National Court's decision aligns with earlier assessments by the prosecution, which argued on 7th October 2026 that the European ruling left no legal basis to continue the proceedings.
