The eviction of Btissam and her two daughters from Carrer de la Marina, 221, in Barcelona's Eixample district has been halted, according to the [Eixample Housing Union announcement reported by Llibertat.cat](https://www.llibertat.cat/2026/10/aturat-el-desnonament-de-la-btissam-i-les-seves-dues-filles-a-l-eixample-de-barcelona-61620?ref=barna.news). The immediate effect is that the family, who have no alternative home, will not lose the flat in the coming days.

ONA Hotels, a company operating in the hotel sector, had sought the eviction. The union said the case was paused using measures that can delay some eviction proceedings involving vulnerable households.

## A temporary pause, not a housing solution

The protection is linked to Royal Decree-Law 26/2026, which took effect on 1 October. Under the measure, eviction proceedings involving vulnerable tenants can be put on hold for up to two months while the relevant public authority offers alternative accommodation or assumes the household's debt, according to SmartLandlord's summary of the decree.

> The Eixample Housing Union described the measures as “temporary patches” which postpone court proceedings without resolving a family's housing vulnerability.

For Btissam and her daughters, the suspension does not amount to a guarantee of stable rehousing. The union said that paused cases could be restarted if the legal or government framework changes.

## Election date adds uncertainty for paused cases

Spain's early general election is scheduled for Sunday 29 November. Prime Minister Pedro Sánchez called the vote after parliament rejected two housing-related decree laws, the BBC reported on 5 October.

Residents facing comparable proceedings can ask a housing union or legal representative whether the court can be asked to apply Royal Decree-Law 26/2026\. In a Sant Andreu case reported by ARA on 1 October, the Catalan Tenants' Union legal team submitted a request for the decree to be applied and the court suspended the eviction.

The Eixample Housing Union has called for continued collective organisation to defend the family's right to remain housed while the suspension is in force.
